Demleen is a web platform available at www.demleen.com (the “Site”).

This Site is published by Demleen, located at 5 Avenue du Général de Gaulle, 94160 Saint-Mandé, France, registered in the Créteil Trade and Companies Register under identification number 911783736 (hereinafter the “Publisher”). Demleen is accessible to users (the “Users”).

Demleen is hosted by OVH, whose registered office is located at 2 rue Kellermann, BP 80157, 59053 Roubaix Cedex 1 - France. This host can be contacted at the following email address: contact@ovh.com.

The purpose of these Terms and Conditions of Use (the “Terms” or, taken as a whole, the “Agreement”) is to define the terms and conditions governing the relationship between Users and Demleen. In the event of non-compliance with the terms of these Terms, Demleen reserves the right to take any measures necessary to protect its interests and, in particular, to ensure compliance

Access to and use of the Site are subject to acceptance of and compliance with these General Terms of Use.

The Publisher reserves the right to modify, at any time and without prior notice, the Site and its services as well as these Terms of Use, in particular to adapt to developments of the Site by making new features available or by removing or modifying existing features.

Users are therefore advised to refer, before any browsing, to the latest version of the General Terms of Use accessible at any time on the Site.

These General Terms of Use apply, where applicable, to any variation or extension of the Site on existing or future social and/or community networks.

Article 1: Purpose of the Site

The Site allows the User to access, in particular, the following services: information website (the “Service(s)”).

Under these Terms, Demleen grants Users a limited, revocable, non-exclusive and non-transferable right of access to the Services, strictly for personal use. Any use of the platform contrary to its purpose is strictly prohibited and constitutes a breach of these provisions.

Article 2: Access to the Site

To be eligible for the Service, the User may be a natural person or a legal entity.

Demleen reserves the right to suspend or refuse access to the Site to one or more Users.

Article 3: Site Management

The Publisher implements the necessary technical solutions to allow continuous access to the Site for the User. However, it reserves the right to limit or suspend access to all or part of the Site at any time and without prior notice. Such interruption may be necessary in particular for maintenance of the Site or its content, or for any other reason deemed necessary for the proper functioning of the Site by the Publisher.

Use of the platform requires an internet connection and a browser. The platform is accessible at the following address: www.demleen.com.

All equipment and software necessary to access the platform and use the Services remain exclusively the responsibility of the User.

The User may contact the Publisher for any question or request for information concerning the Site, or to report any unlawful content or activities, by email at eryomi@demleen.com.

Article 5: Use of Platform Services

Users undertake not to:

1. transmit, publish, distribute, store or destroy any material, in particular Demleen’s content, in violation of applicable laws or regulations concerning the collection, processing or transfer of personal information;

2. disseminate data, information or content that is defamatory, abusive, obscene, offensive, violent or inciting violence, or political, racist or xenophobic in nature, and more generally any content that would be contrary to applicable laws and regulations or public decency;

3. reference or create links to any content or information available from Demleen’s websites, without Demleen’s express, prior and written consent;

4. use information, content or any data present on the Site in order to offer a service considered competitive with Demleen;

5. sell, exchange or monetize information, content or data present on the platform or the Services offered by the platform, without Demleen’s express and written consent;

6. engage in reverse engineering, decompile, disassemble, decipher or otherwise attempt to obtain the source code relating to any underlying intellectual property used to provide all or part of the Services;

7. use software or manual or automated devices, coding robots or other means to access, explore, extract or index any page of the Site;

8. jeopardize or attempt to jeopardize Demleen’s digital security. This includes attempts to monitor, scan or test the vulnerability of a system or network, or to breach security or authentication measures without prior express authorization;

9. counterfeit or use products, logos, trademarks or any other element protected by Demleen’s intellectual property rights;

10. simulate the appearance or operation of the Site, for example by mirroring;

11. disrupt or interfere, directly or indirectly, with Demleen, or impose an unreasonable load on the Site’s infrastructure, or attempt to transmit or activate computer viruses via or on the Site.

Users are reminded that violations of system or network security may result in civil and criminal liability. Demleen verifies the absence of such violations and may call upon judicial authorities to prosecute, where appropriate, Users who have participated in such violations.

Users undertake to use the Site in good faith, in accordance with its purpose and with applicable legal and regulatory provisions, these Terms, and current practices.

Article 6: Intellectual Property

All content of the Site, including designs, texts, graphics, images, videos, information, logos, button icons, software, audio files and others, belongs to Demleen, which is the sole holder of all related intellectual property rights.

Any representation and/or reproduction and/or partial or total exploitation of the content and Services offered by Demleen, by any means whatsoever, without Demleen’s prior written authorization, is strictly prohibited and may result in legal proceedings.

Article 7: Personal Data

All personal data held by Demleen is collected lawfully and fairly in accordance with the privacy policy accessible at the following address: privacy policy.

This data is provided by Users who voluntarily and expressly accept these Terms, thereby authorizing Demleen to process, disclose or transfer such data to any third party in order to enable (i) the User to fully benefit from the Services and features offered by the Site, (ii) prevent any fraud and/or (iii) for statistical purposes.

Personal data is stored by Demleen for processing within the framework of the use of the Services. It is retained for as long as necessary for the provision of the Services and features offered by the Site.

The User always remains the owner of the information concerning them that they transmit to Demleen. In accordance with Law No. 78-17 of January 6, 1978, as consolidated on March 24, 2020, the User has the right to access, rectify and delete personal data concerning them, as well as the right to object, for legitimate reasons, to the communication of such data to third parties.

A response to the User’s request will be sent within 30 days.

Article 8: Liability

Users are reminded that data published by Users and information shared by them may be captured and used by other Users or third parties. In this respect, Demleen does not guarantee respect for ownership of such data; it is the User’s responsibility to take all necessary measures to preserve ownership of their data.

Demleen does not guarantee uninterrupted or error-free operation of the Services. In particular, Demleen shall not be held liable in the event of interruption of access to the platform due to maintenance operations, updates or technical improvements.

In any event, Demleen shall under no circumstances be liable for indirect or unforeseeable losses or damages suffered by the User or any third party, including in particular any loss of profit, unsuccessful investment, inaccuracy or corruption of files or data, damage to image or business reputation, loss of turnover or profit, loss of customers or loss of opportunity, on any basis whatsoever.

Furthermore, Demleen shall not be held liable for any delay or non-performance of this Agreement justified by a force majeure event as defined by the case law of French courts.

Article 9: Evidence Agreement

Computer systems and files shall constitute evidence in the relationship between Demleen and the User.

Thus, Demleen may validly produce in any proceedings, for evidentiary purposes, data, files, programs, records or other elements received, issued or stored through the computer systems operated, on any digital or analog medium, and rely on them except in case of manifest error.

Article 10: Severability

If any provision of the Agreement is or becomes illegal or unenforceable, this shall in no way affect the validity or enforceability of the remaining provisions of the Agreement.

Article 11: Dispute Resolution

The conclusion, interpretation and validity of this Agreement are governed by French law, regardless of the User’s country of origin or the country from which the User accesses Demleen, and notwithstanding conflict of law principles.

In the event that a dispute relating to the validity, performance or interpretation of this Agreement is brought before civil courts, it shall fall under the exclusive jurisdiction of French courts, which are expressly granted jurisdiction, even in the case of summary proceedings or multiple defendants.

The User is informed that they may, in any event, resort to conventional mediation or any alternative dispute resolution method (such as conciliation) in the event of a dispute.

Article 12: Duration of the Terms of Use

These General Terms of Use are concluded for an indefinite period. The User is required to comply with them from the start of their use of the Services.

The Publisher reserves the right to modify this document at any time and without prior notice. Users will be informed of each update of the document.
